How Maternity Leave Works in Ontario

Ontario's maternity leave policy provides eligible parents with paid time off to care for a newborn. The program includes two main components:

Parental Benefits Program

The Parental Benefits Program provides:

  • Up to 26 weeks of parental benefits
  • Up to 50% of your average weekly earnings (up to a maximum)
  • Flexible use of benefits between parents

Employment Insurance (EI) Maternity Benefits

EI maternity benefits provide:

  • Up to 15 weeks of benefits
  • Up to 55% of your average weekly earnings (up to a maximum)
  • Additional weeks if you have young children

Note: You can receive both parental benefits and EI maternity benefits, but the total leave period cannot exceed 52 weeks.

EI Eligibility and Benefits

To qualify for EI maternity benefits, you must:

  • Have worked enough insurable hours in the 52 weeks before your leave
  • Be at least 18 years old
  • Be a Canadian citizen or permanent resident
  • Be pregnant or have given birth to a child

EI Maternity Benefit Rates

The EI maternity benefit rate is calculated based on your average weekly earnings:

EI Maternity Benefit = (Average Weekly Earnings × 55%) × Number of Weeks

The maximum weekly benefit is $535.50 as of 2023.

Additional Weeks for Families

If you have young children, you may be eligible for additional EI weeks:

  • 1 additional week for each child under age 6
  • Up to 10 additional weeks total
